Service Policies

Webs-n-Banners (WNB) agrees to provide web hosting, email services and domain services.  WNB reserves the right to suspend or cancel any client's access to any portion or all of WNB services, if we find that the account has been used inappropriately.  WNB reserves the right to refuse service and/or access to its servers to anyone.

 

Support

Free customer support is provided via email and through 1-225-677-9224.  Billing inquiries will be answered within two business days.  Client agrees not to spam support.  WNB does not provide custom programming and scripting, or web site consulting services as part of our hosting services.  We do offer these services for a fee.  Call or email for more details*

User Policy

1. Illegal activities.  WNB prohibits sites engaged in: Illegal activities including, but not limited to, storing and/or distributing illegal copies of copyrighted software, warez sites, violations of copyrights and trademarks, violations of U.S. laws, selling and/or distributing illegal contraband.
Internet abuse including, but not limited to, spamming (unsolicited Emailing), distribution of mass emailing programs, posting obscene or inflammatory messages, threatening other Internet users, mail bombing Internet users.  Systems abuse including, but not limited to, use of excessive CPU resources, use of excessive disk space, use of excessive email storage space.

2.Adult content: We do not allow the presentation, promotion or transmission of adult, pornographic or obscene images, text or other content.

3.Policy Violations: Should a policy violation occur, WNB reserves the right to terminate the account without notice and without any refunds. The policy violating client will be held responsible for any damages to WNB, including but not limited to, WNB system, servers, connectivity, reputation, business, service, network, operations, or equipment.  The policy violator may be charged a clean up fee. 

 

Web Site Content

The client is responsible for keeping a copy of their most current web site files as backup on a remote system (not on WNB servers). WNB is not responsible for any lost files, information, or data. Should any data need to be recovered, there will be a charge of $100.  WNB does not guarantee to possess the most current copy of a client's website, unless WNB maintains the client's website.

Payment Policy and Fees

We do not charge set-up fees on ANY sites. We are not responsible for changes made to the site by someone other than an employee of WNB. If WNB has to re-design any or all pages, charges will apply. Ask your designer for details.

Maintenence plans are available in monthly, quarterly, semi-annually or yearly plans.  We are very flexible.  **Please note that we do offer discounts when you sign up for a semi-annual or yearly plan with recurring billing.** 

All hosting services are available in one year prepayment plans. Full payment is required before any hosting service is rendered, which includes renewals.  All  payment-due notices will be sent by electronic mail.  If there is no reply to an electronic invoice, a bill or invoice will be sent by postal mail or fax.  Prepayment is due each anniversary following the date the account was established.  Once your site is set-up, you your maintenence fees will be billed the following month.

*If you choose to have the graphics or layout of your site re-designed, the fees will be $20 per page or a minimum of $100. 

 

Payment Method

WNB accepts credit card payments (Visa, MasterCard, American Express), PayPal, or Cashiers Checks and Money Order via U.S. Mail.  Our preferred method of payment is through credit card.  We do offer recurring billing plans.  If you would like to sign up for recurring billing, please download one of the forms below.

Refunds

You may cancel at anytime. If you choose to cancel your account we do not offer refunds on monthly, quarterly or hosting plans. Please keep in mind that your domain name, registration fee and server fee are never refundable - as you may continue to use our server without our design services. We will not refund any fees for the semi-annual if cancelled within 30 days of the plan renewal or yearly plans if cancelled within 60 days of plan renewal. Refunds will be returned to you within 45-60 days of the actual day of cancellation. Payment must be received or services will  not be rendered. If payment is not received on time the account will be cancelled.

 

Price Changes 

WNB reserves the right to change prices at any time.

All monetary transactions will be in $US dollars.

Additional features can be added at any time (Ask your designer for details.)

Add-on costs are non-refundable regardless of whether or not the service was used.

 

Discounts and Special Offers

All discounts must be used up front with the initial quote of the site price. All Special offers (i.e. business cards, postcards, magnets, brochures, banners, etc.) are to be ordered within 30 days of the completion of the web site. NO EXCEPTIONS.

 

Renewal Notification and Billing Schedule

Renewal notification is emailed to the billing contact on the 1st of the month.  All invoices or statements are due no later than the 25th of the month. 

If Payment is not received via Credit Card, PayPal, or through the U.S. Mail BY THE DUE DATE the account will be temporarily shut off until payment is made.  Failure to pay within the following 10 days will result in cancellation.

 

Account Reactivation

If an account is cancelled due to client request or billing issues and the client desires to reactivate the account, a non-refundable reactivation fee of $25.00 will be required prior to account reactivation.  Accounts are reactivated after all outstanding charges are paid, including hosting fees, additional features, and  check processing fees. If an account was cancelled due to policy violation, WNB will not reactivate the account.

 

Refund Policy

If WNB terminates an account due to policy violation, there will be no refund.  Fees associated with additional features are non-refundable. There will be no refund on design fees once the work is completed and approved.  There will be no refunds on deposits unless the work is unable to be completed. 

We will offer refunds on prepaid maintenence fees if made within the following time frames:

Semi-annual payment plan:  If refund and termination is requested within the first 4 months of service, a prorated refund will be given.

Annual payment plan:  If refund and termination is requested within the first 8 months of service, a prorated refund will be given.

 

Cancellation

WNB reserves the right to terminate service at any time.  If an account is terminated for a policy violation there will be no refund.  WNB reserves the right to delete the policy-violating web site content without notice. Customers can cancel service at any time.  All account cancellations are to be requested through the phone 225-677-9224 AND via email.  If the client requests cancellation, their account will be terminated at the end of the current billing cycle, or immediately.  If the client specifies immediate account termination, WNB reserves the right to delete the web site contents without notice.  If an account is cancelled due to non-payment, WNB reserves the right to delete the web site contents without notice.

Should the WNB client decide to keep the web site content information for re-use, the client may sent a notice to WNB via e-mail along with $3.00 s/h, and the content will be put on CD or DVD and mailed to the client's billing address.

 

Indemnification

Client agrees to defend, indemnify and hold harmless WNB against any liabilities arising out of defective products sold to customers from WNB servers, personal injury or property damage caused by products or services sold or distributed from WNB servers, any material that infringes or allegedly infringes on the rights of a third party available from WNB servers, and any material that libels or allegedly libels a third party available from WNB servers.

 

Disclaimer

WNB is not responsible for any damages to any client's business. WNB makes no warranties or guarantees of any kind, expressed or implied for services that we provide. Use of WNB web hosting and email service is at the client's sole risk. WNB's services are provided on an "as is, as available" basis. WNB does not guarantee that our services will be uninterrupted or error free.  WNB will provide every effort in good faith to ensure that its services are available to as many Internet users as possible with minimal service interruptions. In no circumstance will WNB be liable for any claims resulting from the use or inability to use WNB's services including, but not limited to, service interruptions, client errors, Internet connectivity problems, miscommunications, unauthorized access to WNB servers, DNS caching, Internet bandwidth congestion, power failures, vandalism, and natural disasters.

 

Webs-n-Banners reserves the right to revise our policies at any time.
